These Terms of Service (“Terms”) govern your access to and use of the website mixxbee.com (the “Site”) and the digital marketing services provided by MixxBee (“we,” “us,” or “our”). By accessing our Site or purchasing our services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.
Services
MixxBee provides digital marketing services, which may include search engine optimization (SEO), social media marketing, content marketing, email marketing, and marketing automation. The specific scope, deliverables, timeline, and fees for your engagement will be set out in a separate proposal, order form, or service agreement (“Service Agreement”). In the event of a conflict between these Terms and a signed Service Agreement, the Service Agreement controls.
Quotes and Pricing
Fees for our services are described in your Service Agreement or quote. Unless otherwise stated, all prices are in U.S. dollars and exclusive of any applicable taxes. We reserve the right to change our pricing for future engagements at any time.
Payment Terms
- Payment is due according to the schedule set out in your Service Agreement (for example, upfront, monthly in advance for retainers, or per milestone).
- Payments are processed through our third-party payment processor, Stripe.
- For recurring or retainer services, you authorize us to charge your payment method on a recurring basis until the engagement is cancelled in accordance with these Terms.
- Late or failed payments may result in suspension of services until the outstanding balance is paid.
Client Responsibilities
To deliver our services effectively, you agree to:
- Provide accurate and complete information
- Provide timely access to accounts, assets, and materials we reasonably require (for example, social media accounts, website access, brand assets)
- Review and respond to deliverables and requests within a reasonable time
- Ensure you have the rights to any content, trademarks, or materials you provide to us
Delays caused by failure to provide required access or feedback may affect timelines and are not grounds for a refund.
Cancellation
You may cancel ongoing or recurring services in accordance with the notice period stated in your Service Agreement (and in our Refund Policy). Cancellation does not entitle you to a refund of fees for services already performed.
Intellectual Property
Upon full payment, deliverables we create specifically for you become your property, except for any third-party materials, tools, or our pre-existing methodologies and templates, which remain our property or that of their respective owners. We retain the right to display non-confidential work in our portfolio unless otherwise agreed in writing.
Results Disclaimer
Digital marketing results depend on many factors outside our control, including search engine and platform algorithms, market conditions, and your industry. While we use professional best practices, we do not guarantee specific rankings, traffic, conversions, sales, or other results.
Limitation of Liability
To the maximum extent permitted by law, MixxBee shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability for any claim shall not exceed the amount you paid to us for the services giving rise to the claim in the three (3) months preceding the claim.
Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the services.
Termination
We may suspend or terminate your access to our services if you breach these Terms or fail to make payment. Provisions that by their nature should survive termination (including payment obligations, intellectual property, and limitation of liability) will survive.
Governing Law
These Terms are governed by the laws of the State of Arkansas, USA, without regard to its conflict of law principles.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our services after changes constitutes acceptance.
